Phxt “Defense Moves to Dismiss Comey Case, Citing Political Bias and Vindictive Prosecution”

WASHINGTON (TNND) — Lawyers representing former FBI director James Comey asked to dismiss his criminal case, citing a “vindictive and selective” prosecution. Comey’s lawyers argued that President Trump had a personal animosity towards Comey.
Patrick Fitzgerald and Jessica Carmichael, two lawyers leading Comey’s defense team, submitted the motions Monday afternoon to have his case dismissed with prejudice.
“President Trump ordered the Department of Justice to prosecute Mr. Comey because of personal spite and because Mr. Comey has frequently criticized the president for his conduct in office,” Fitzgerald and Carmichael said on Monday.
“The indictment in this case arises from multiple glaring constitutional violations and an egregious abuse of power by the federal government,” they argued.
It is difficult to have a case dismissed on grounds of selective or vindictive prosecution.
To do so, Comey’s legal team must prove that prosecutors were acting with genuine animosity in bringing the criminal case to court — and that the prosecutors singled him out.
While the next steps in the case are unknown, the Justice Department and the Trump administration will likely seek to file a lengthy response to rebut the allegations.
